During the 28-year-old accused’s third appearance in the Brakpan Magistrates’ Court this month, the magistrate warned the state that if the DNA results were not available at the next hearing, he would throw the case out.

Phyllis Vorster, the prosecutor in AfriForum’s private prosecution unit that is dealing with the matter, said the magistrate had added that the required DNA profiles had to be presented on the same day of that hearing. Consequently, the unit was not very optimistic that these would be available in time.
