Judgment expected in Sanral secrecy case

Johannesburg - The Western Cape High Court is expected to hand down judgment in Sanral's and the Protea Parkway Consortium’s (PPC) secrecy applications on Thursday, transport MMC Brett Herron said.

The SA National Roads Agency Limited applied to the court to prevent the City of Cape Town from filing its supplementary founding papers in an open court because of commercial confidentiality.

"The secrecy applications sought to prevent the city from filing its supplementary founding papers, filed in the review application instituted by the city as an open, public record," he said in a statement.

The supplementary papers were said to contain important details about the construction of the N1/N2 Winelands Toll Highway project and the costs involved.

In May last year, the city was granted an interim interdict to halt the proposed project. The interdict remains in force until the court reviews Sanral's declaration of the project and the selection of the preferred bidder.

The city is opposing both Sanral's and PPC’s applications to keep the founding papers secret.

The court heard argument on the secrecy application on August 2 and 5 and judgment was reserved.

Herron said the city would only find out by Thursday whether judgment would be given in camera or in an open court.

"I will be at the court and will attend the proceedings in the event that they are open to the public and the media," Herron said.
