Whilst sitting in the darkness of yet another Escom induced blackout my mind wandered to the question whether our ,or for that matter Western Countries incl countries from Africa ,Judiciary are making to much of the Human Rights of our citizens and whether they have lost touch with what the person in the street want . Looking around us we see what we perceive rampant crime and injustices committed against normal citizens and a cry for those perpetrators to be justly punished only to be confronted with a judiciary that is hellbent to uphold said perpetrators human rights in respect of for eg their rights to silence ,attorneys etc even though most is repeat offenders well aware of these rights and at their own whim exploit such during process .Is it not time we educate from young our communities ,citizens regarding their rights and when it come to court processes dispense of these allegations that makes trials deemed unfair because the police failed to inform them of such and such and rather address whether they are guilty or not . When asked questions there should be an onus on citizenry to explain and so it should be in court that when an accused is confronted with evidence against him he should answer and not use a violation of his rights to get off on a technicality .The judiciary is not only there to protect our individual rights but also those of the broader community .If the police is found to have violated any right this should form a different trial where the police is called to explain and sanction against them be given . We all have a duty to ourselves and to the state whom after all we voted into power .The police is being policed by independent civilian oversight and violations of rights should also so be investigated .Our basic human rights is a must but must also be tempered by what we as a society want and be beneficial to all of us .The rights of an individual cannot surpass those of a society that wants to see justice done .
