All day, I've been reading about everyone from Donald Trump to Pietie down the street lambasting the judge in the Oscar Pistorious case for her decisions.
I want you to take the time to think before you do so again.
Here's the thing: legally, premeditation would mean planning ahead.
For instance, if Oscar had NOT owned a gun, but had bought one shortly before the murder, that might indicate premeditation. That is, that he had thought about and planned the crime ahead.
There was no evidence of that sort of premeditation in this trial.
Now to the verdict of not guilty of murder.
Had the judge ruled that he was guilty of premeditated murder, she would immediately have opened the door to an appeal based on the grounds that there was no premeditation (see above.)
Oscar would almost certainly have won that case, and end up doing no jail time.
By finding him guilty of culpable homicide, which IS verifiable through the evidence, she is ensuring that it's going to be that much harder to overturn any decision.
Essentially, she can hand down a 15 year sentence (the max for this charge), and it will be MUCH harder to appeal.
This was not a corrupt decision - it was a smart one.
As long as she gets the sentencing right, this is the only way to ensure that Oscar serves time for the crime.
Got it? Good.
Now lets wait until sentencing before we talk about him getting off 'scott free?'
