I can not understand how there are so many comments crucifying Judge Masipa, People have totally let there emotions and opinions get the better of them, they have not looked at the decision in an objective veiw as a judge is suppose to do.
In my personal opinion and in terms of prosecuting people from a Human Rights point of view, you can not prosecute a person unless there is evidence beyond a reasonable doubt for the crime, as the americans say rather have 10 murders on the street then 1 innocent person in Jail.
Judge Masipa from this point of view undoubtably made the correct decision then, she did not let her emotions or feelings take over, she simply took all the evidence supplied by the state and defence, all credible witness statements and testimonies put them all together and made the decision. Watching the proceedings every day, in my mind there is absolutely no evidence that undoubtedly proves he intentionally did it. People can make there own assumptions and judgments but that means nothing with out concrete evidence.
Do i personally think he is guilty? I don't really know to be honest, the main thing that bothers me is if you hear an intruder the first person you look for is your partner as you need them alert as possible and i can not figure out why he did not look for her, but then on the other hand being a person with such a disability i think if it were me i would definitely feel more venerable than a normal able-bodied person, and would tend to be more "trigger happy" than normal for obvious reasons.
I have also seen a lot of comments whereby people say that even it were an intruder its still murder , to them i can not understand that point of view, speaking from experience saying that and being in that position is two completely experiences. You can not understand the fear, panic and rational thinking you go through, you either have to think to your self shoot and hope for the best or you wait and risk your family get beaten, tortured or raped. Personally id rather go to Jail then see them rape my wife !!! You also have to put your self in he's stumps as well , your absolutely at a huge disadvantage.
