No unconditional release for PAC's Motsamai

Johannesburg – The decision by the High Court in Johannesburg against an unconditional release for the Pan Africanist Congress's Kenny Motsamai has been welcomed by National Commissioner of Correctional Services Zach Modise.

“The court's decision is an affirmation of the correctness of the minister and the department's implementation of the parole system," Modise said. 

He said the decision confirmed that all offenders must abide by the department's legislative and policy prescripts to be able to enjoy privileges such as the parole.

“Parole is a conditional privilege granted to help facilitate smooth and gradual reintegration of offenders into society, while ensuring continued public safety.

"It cannot be claimed as a right and anyone refusing to accept parole conditions compromises the chance of early placement under community corrections."

Motsamai had previously reportedly refused to be released on parole stating that the conditions were unfair.

He lodged an urgent application to force the Department of Correctional Services to release him unconditionally. 

The PAC veteran has been imprisoned for 25 years. He was convicted of killing a traffic officer during the apartheid era.
