AS IT HAPPENED: Day 36, Pistorius trial

accreditation
Oscar Pistorius's agent will return to the witness box where Gerrie Nel will continue grilling him.

Van Zyl said on Tuesday that Pistorius had only lost his temper twice in the eight years they had worked together.

Earlier on Tuesday, Nel cross-examined acoustics expert Ivan Lin on ambient noise on the morning of Valentine's Day last year, when Pistorius shot dead Reeva Steenkamp.

That's where we'll close updates. Cheers. Watch a full summary of day 36 here:

02 Jul 2014

We can't do anything about what was published before 15:05 but as of this moment, prohibition order stands.

02 Jul 2014

Masipa grants order.

02 Jul 2014

Oldwadge asks Masipa to grant an order prohibiting the publication other than conclusions of the reports.

02 Jul 2014

Oldwadge makes request to the court. He raises issue about psych reports having been released to the media with intimate details...

02 Jul 2014

WD: In test, when you get the shock that you've been anticipating, the high fear group respond with higher startle.

02 Jul 2014

WD reads findings from study that show in high-fear group startle responses are higher.

02 Jul 2014

WD explains how startle response is produced and how quickly or forcefully the eyes shut, the body reacts... He explains how shock is administered to test subjects and examine their expectations of fear...

02 Jul 2014

WD: people in experiments are place in front of computer with electrodes over eyelids, body, measure muscle reactions...

02 Jul 2014

WD: Hippocampus, prefrontal regions are active in situations of fear...

02 Jul 2014

WD: Both hippocampus and pre-frontal cortex contain memory patterns that instantly activate when danger is perceived..

02 Jul 2014

WD: The hippocampus forms important link between thinking brain and the amygdala that governs automatic responses..

02 Jul 2014

WD says he's going to describe the brain very slowly, court must say if he's going too fast...it's very important.

He holds up a diagram of the brain and painstakingly describes every sort. Draws attention to the mid-brain. He says the mid-brain is the most ancient, primitive part of the brain - the amygdala governs the fight and flight response.

02 Jul 2014

WD fight or flight evidence seems to be defence response to Nel questioning why OP confronted perceived threat.

02 Jul 2014

So now polar bears are getting a mention. Yesterday it was Andrea Bocelli, today polar bears...

02 Jul 2014

WD says it might be that people pit themselves against the 'superhumans'...but it's a complex issue.

02 Jul 2014

WD says UK introduced legislation to enhance understanding of disability hate crimes.

02 Jul 2014

WD cites another US study which found that disabled people were twice as likely to suffer from attacks.

02 Jul 2014

Adults with disabilities "at higher risk of violence" says WD, citing study.

02 Jul 2014

WD says he believes people with disabilities more at risk from the attack than the able-bodied.

02 Jul 2014

Oldewadge immediately moves on...

02 Jul 2014

Judge rules WD's evidence of letters are hearsay.

02 Jul 2014

Judge Masipa says she's not going to entertain further arguments: "The evidence is not relevant."

02 Jul 2014

Judge says the case law cited by Oldwadge doesn't assist the defence in this argument.

02 Jul 2014

Judge: The sources, the two individuals with disabilities, refer to their own circumstances, cannot be relevant in this case.

02 Jul 2014

Judge: Courts usually accept expert sources consulted by experts who won't come to court and cannot be cross-examined.

02 Jul 2014

Judge says it's important to compile the nature of the evidence compiled by Derman in his report.

02 Jul 2014

Court is in session.

02 Jul 2014

Psych report: He admits that he went through a period where he made the wrong choice of friends and often acted in way he wasn't proud of.

02 Jul 2014

Also in the psychiatric report: OP says he can't sleep, has lost 10kg and no longer feels motivated.

02 Jul 2014

According to the psychiatric report, OP shows symptoms of agoraphobia and social phobia.

02 Jul 2014

From the psychiatric report: There is evidence to indicate that Mr Pistorius was genuine with his feelings towards Ms Steenkamp

02 Jul 2014

Court adjourns. It will resume at 14:00. Enjoy your lunch, everyone!

02 Jul 2014

Nel finishes. Judge confers with assessors.

02 Jul 2014

Nel: I haven't had as much time as Mr Oldwadge to prepare or peruse the case law.

02 Jul 2014

The basic evidence for hearsay is that it is evidence of a non-witness.

02 Jul 2014

Nel: Email says woman's flight or fight response is quicker at 50 than many people's. "Why would you present that if nobody can test it?"

02 Jul 2014

Nel: Oldewadge with the utmost respect is wrong.

02 Jul 2014

On the test for hearsay, it's hearsay. We're hearing evidence from a witness we can't cross-examine.

02 Jul 2014

Oldewadge: Mr Ne's objection is premature.

02 Jul 2014

Oldwadge says these are collateral sources, much like those that would be cited in a psychological report.

02 Jul 2014

Oldewadge was clearly prepared for this objection. He's been reading an argument in response for the last 10 minutes.

02 Jul 2014

Oldwadge argues emails not hearsay because Derman is not using them to prove truth of fight or flight testimony

02 Jul 2014

Oldwadge is referring to case to argue why this evidence is not hearsay.

02 Jul 2014

Oldwadge: he suggests what is contained in this email is hearsay evidence...I take exception to the submission by Mr Nel.

02 Jul 2014

Nel objects as Derman reads from Kent's email. He says it's hearsay. "It's going too far..."
