The EFF argues that its MPs who were forcefully ejected from Parliament after protesting at two of then-President Jacob Zuma's State of the Nation Addresses (SONAs) should be awarded the same type of "constitutional damages" given to the victims of the Life Esidimeni scandal.
In an application against the National Assembly speaker, police minister and chairperson of the National Council of Provinces (NCOP), former EFF MP Godrich Gardee accuses parliamentary authorities of using "the white shirts [security officials] to punish the members of the EFF for uttering critical statements regarding former president Zuma's unfitness to address the joint sitting" at SONA.
"The Parliamentary Protection Services used unreasonable force, violence and aggression in order to pursue the ends that were desired by [the speaker and the NCOP chairperson], which were to frustrate the fulfilment of the [EFF MPs'] parliamentary duties," he stated.
