The local franchise holder of the Pick n Pay store has now appealed the decision by the liquor licensing authority in the Western Cape after their application for a licence to sell liquor was turned down as being “not in the public interest”.
The franchise applied on 27 January last year for the granting of an off-sales liquor licence (bottle store) to be in a shop in The Arcade where the present Pick n Pay supermarket is situated.
“After consideration of the submissions of Pick n Pay and all the comments from residents of Fish Hoek and interested organisations the Western Cape Liquor Licensing Tribunal (LLT) refused the application on 11 June 2018.
“The grounds given for the refusal were that the LLT was of the view that the granting of the licence was not in the public interest,” says Donald Moore, leader of the Keep Fish Hoek Dry campaign.
Pick n Pay have now given notice of appeal and review of the decision of the LLT to the Western Cape Liquor Appeal Tribunal (WCLAT).
“The grounds for the appeal run to 41 pages. The parties to the matter are Pick n Pay as the Appellant and LLT as the Respondent. It is believed that both the rejection notice and the notice of appeal have been sent by the Western Cape Liquor Authority to all persons who lodged representations/objections, provided they gave an e-mail or physical address when lodging their representations,” says Moore.
It is possible for residents of Fish Hoek who wish to oppose or support the appeal to do so.
Regulation 34 of the regulations in terms of the Liquor Act were amended in 2017 to make provision for any interested party to lodge a submission with the Western Cape Liquor Appeal Tribunal (WCLAT) but sets out very strict requirements with which any such submission must comply.
Moore, a resident and retired lawyer of Fish Hoek, has offered to prepare and submit a combined representation to the WCLAT and to incorporate as many views as possible that are opposed to the appeal that has been lodged.
