Hellman says the privatisation of state-owned enterprises can make them vulnerable to state capture. State-owned enterprises "can become this remarkable arena for state capture" he explains, saying the captors often push for privatisation.

Kaufmann cites a paper called "Legal Corruption", says state capture networks use illicit means to override laws governing conflicts, executive ethics, lobbying, etc.

Kauffmann says in countries where there is also a thriving media, where there is civic space (healthy civil society), and civil liberties, there is a much better chance of addressing the challenge of state capture.

Hellman: With state capture, it is a form of corruption that affects the very formation of laws, rules and regulations, so that the "laws, rules and regulations were shaped to the advantage of individuals or firms and they were using their close relationship to politicians and public officials in order to actually shape the legal system and indeed, the very nature of the state, to their own advantage."

Hellman explains how state capture differs from "administrative corruption".
