Zuma allowed to argue leave to appeal against state capture report costs order

A full bench in the North Gauteng High Court has granted former President Jacob Zuma the right to intervene in the leave to appeal application against a judgment that said he should pay the costs of reviewing Thuli Madonsela's remedial action for the institution of the state capture inquiry.

This allowed the former president to apply for leave to appeal the personal costs order against him, which was made by the same court in December last year.

Madonsela recommended Zuma establish a commission of inquiry into state capture and that Chief Justice Mogoeng Mogoeng choose the judge to preside over it.

The report looked into whether Zuma's friends, the controversial Gupta family, had undue influence on the executive. Zuma took the recommendation on review, arguing that only he has the authority to appoint the judge. This was dismissed by the court last year.

The leave to appeal application is currently underway with the DA and the EFF opposing it.

Zuma instructed his lawyers in December of 2017 to file an application for leave to appeal the ruling ordering him to set up the inquiry.

Zuma thought the court erred by holding him personally liable for the legal costs as he was not cited in his personal capacity or given an opportunity to explain his conduct to decide on punitive ruling.
